Restorative Justice
Restorative justice is the idea that when one person causes harm to another, justice should focus on repairing that harm through cooperative processes involving the person(s) harmed, the person(s) who caused the harm, and others in the community around them.
In the workplace misconduct context, a restorative justice approach allows the people most affected to decide on the corrective action that meets their needs and on what is shared publicly about the process and outcome. At the Purple Method, we believe the principles of restorative justice can be applied effectively in a workplace context for the following key reasons:
Restorative Justice Addresses Reluctance to Report: People who have been harmed are often reluctant to report because they don’t want to get other people in trouble, and/or they may not trust that the system/organization will be accountable to the harm in a way that is meaningful. Rather than punishment, they often want the opportunity to talk to the person directly, understand their motivations, explain their experience, and ask for what they need.
It Allows Affected Individuals to Define Justice: Using restorative justice principles relieves organizational leaders from having to determine the most just outcomes. It allows affected individuals to determine for themselves what accountability and justice look like.
It Focuses on Accountability Over Punishment: A key part of the restorative justice practice is the idea of responsibility being taken rather than imposed. By collectively deciding what accountability means on the basis of understanding and shared values, the individual causing the misconduct is more motivated to take action and grow as a person. You are likely to see more satisfying and sustainable outcomes for all involved.
It Addresses the Causes of Harm: Restorative justice creates space to examine all of the intersectional personal and institutional factors that contributed to the harm so that it can be prevented from happening again.
